Compliance & Regulation
Does Your RTD Need a Nutrition Facts Panel?
A can format does not determine nutrition-labeling requirements. Product classification, alcohol content, and applicable exemptions need to be established first.
"Confirm the product's classification and applicable requirements before reserving panel space."
Start With Product Classification and ABV
For wine, the FAA Act labeling boundary begins at 7% ABV, not above 7%. Wine and cider below 7% ABV do not require a TTB wine-label COLA, but must meet applicable FDA ingredient, nutrition, and allergen requirements. TTB's Internal Revenue Code labeling requirements and the health warning for beverages at 0.5% ABV or more still apply. Other beverage classifications need their own assessment rather than an assumption based on the can format (TTB, wine below 7% ABV; TTB, cider FAQs).
FDA nutrition labeling is subject to applicable exemptions; it is not accurate to say that every FDA-covered beverage must carry the same panel in every circumstance. Eligibility depends on the product and business, and some claims can affect exemption eligibility. See FDA's small-business nutrition-labeling exemption guidance before relying on an exemption.
An RTD Format Does Not Establish Jurisdiction
A wine-based drink, a spirits-based cocktail, and a product regulated as a malt beverage can require different label information even when sold in similar cans. Establish the product classification and applicable rules with the producer or qualified regulatory adviser before finalizing artwork. The RTD packaging design article addresses the related visual-system decisions, not a determination of regulatory jurisdiction.
Confirm Jurisdiction Before You Finalize the Layout
Reserve space for the information your product actually needs: nutrition or other required disclosures, ingredient and allergen information where applicable, the relevant product designation, and the health warning where required. These obligations can overlap; the absence of a COLA requirement does not mean an absence of TTB labeling requirements (TTB, wine below 7% ABV).
Status checked October 29, 2026: TTB Notice No. 237 proposes an Alcohol Facts statement for FAA Act-covered beverages. The official sources checked identify it as a proposal, not an effective mandatory Nutrition Facts requirement. Recheck the official rulemaking listing before using a proposed rule or date to set production specifications.
